The owner went to a patent lawyer and they have enough differences between the two to get their own patent on the bolt on design without infringing on malibu's design, that and it's just one guy, selling them for pretty much cost of material and shipping, Malibu would waste more money than it was worth to even think about going after one guy over a few dozen homemade poorgates
He's just helping people get a killer wave without having to upgrade the boat they just purchased, he's doing it all for fun and for the users on this board, I for one appreciate his enthusiasm and effort to help us out who don't want to upgrade to a new boat any time In the foreseeable future, I love my '10 model and don't want to upgrade, my boat is just the way I want it
Don't get me wrong, I love what the guy is doing. I saved a bunch of cash on my boat because it does not have SG. I hope to put together a poorgate of my own soon. BUT Malibu is a public company with shareholders so spending a ton of money to bring the hammer down on a cool guy doing something sweet sounds exactly like a dumb move that publicly owned company would do.
