No idea how marine laws work compared to automotive, but you may double check. When the clean diesel requirement came out in CA at first, this was about 2007, a lof ot the diesels could not be sold as new vehicles. However, there was an exception for used vehicles. A lot of Mercedes dealers had CDI's as demos, because after a relatively low number of miles, they could sell them in CA to dealers, who would then legally be able to sell them as used. By 2009, the CA emissions were 50 state (and they went from CDI to Blue Tech in Mercedes, another other large diesel voluem dealers like VW started selling more in CA again). Don't recall the details about it, but I'm pretty sure there was something like that that was essentially a loophole (of course, I was pretty sure about cats, too!). Regardless, you may just check before completely ruling it out.

Ya, I would assume if the boat had been sold pre 08, it would be legal to bring into CA used, but since they were produced after the law, that doesn't work. I got in contact with malibu and actually had the western product rep call and have a conversation with me. Great service and I don't even own a boat! Back to the point, he informed me that basically all 2011's outside of CA were ordered without cats to keep the prices down, which is definitely not CA legal. He said all 2012's have cats and most should be fine for CA, just double check with malibu before I purchase and they would confirm that specific boat is legal.

Walter that was what I have seen/heard anything outside of CA says no no no for CA waters. Just didn't want to end up stuck and now I have the information I was looking for. Kind of sucks as i had my eye on a 2011 in the classifieds. Oh well, still have a few more 2012's I've been eyeing that will hopefully be around in dec when I'm ready to go. Thanks for the help everyone! Really appreciate it. And a shout to malibu for the great customer service.

I wasn't clear. With cars, the law treats new and used differently. Here's an example. This car was not legal for sale new in CA: http://www.autotrader.com/cars-for-sale ... 0491&Log=0

But it is legal for sale as a used vehicle.

I'd get a hull number, and go to whatever state agency, and see if you can register it.

I see what your saying, but I don't see that happening. And from the looks of those tags and from speaking with malibu, I don't think its possible but I guess I might as well give it a try should the opportunity present itself.
